Terms and Conditions

By commissioning or purchasing artwork/prints from Mark Mannering Barton, you agree to the terms outlined below.

Copyright & Image Usage

  • All artwork created by Mark Mannering Barton, including original pieces, mock-ups, and prints, remains the intellectual property of the artist.

  • The artist retains full copyright on all work produced.

  • The artist may reproduce artwork for prints, calendars, merchandise, or promotional use.

  • Commissioned portraits may be displayed on the artist’s website, social media, and other promotional materials, along with the photo supplied.

  • Purchasing a commission does not transfer copyright or usage rights.

  • If you wish to buy full usage or reproduction rights, please contact the artist to discuss a separate agreement.

  • Unauthorised reproduction, resale, or modification is prohibited and may result in legal action.

Payments & Deposits

  • A non-refundable deposit is required to book a commission. The current deposit amount is listed on the artist’s website.

  • No work will begin until the deposit has been received and confirmed by the artist.

  • The remaining balance must be paid in full and cleared before the artwork is shipped or delivered.

  • Payments are accepted by UK bank transfer only.

  • All prices are in GBP (£) and exclude VAT, as the artist is not currently VAT-registered.

Lead Time & Deadlines

  • Commissions are completed on a first come, first served basis.

  • Lead times vary depending on the artist’s schedule and may be up to four months.

  • An estimated completion date will be given upon enquiry.

  • If you require artwork by a specific deadline (e.g. birthday or event), please mention this at the time of booking. A rush fee may apply.

  • Delays caused by late payments, delayed approvals, or missing information from the client may result in longer wait times.

Shipping & Delivery

  • All artwork is securely packaged and shipped with tracking to the address provided.

  • If the artwork is a gift, it can be shipped directly to the recipient. The delivery address must be clearly specified at the time of order.

  • Hand delivery may be available for local clients, at the discretion of the artist.

  • Overseas orders are welcome, but may incur additional shipping charges and customs duties (see VAT & Import Fees).

Cancellations & Refunds

  • Once a commission is placed and deposit payment made, commissions can’t be cancelled without fore-fitting the deposit.

  • Deposit payments are non-refundable and are retained to cover the artist’s time, loss of turned away business, and administration.

  • The artist is committed to client satisfaction. so if any issues arise, please contact the artist to discuss a resolution.

Revisions & Approval

  • An image of the completed artwork will be provided for approval before shipping. Only small tweaks will be made.

  • Once received, in the unlikely event you would like alterations, the client is responsible for postage costs both ways.

  • Any changes, even if minor will incur additional charges, if not full costs.

  • By commissioning the artist, the client accepts the artist’s individual style and interpretation i.e. I do not guarantee exact details, colour matches or dimensions.

Reference Images/Photos

  • Clients are responsible for providing high-quality, clear, and well-lit photographs for reference I have a page here on how to take images to help you.

  • The artist will inform you if the image is unsuitable for use.

  • The artist reserves the right to decline the commission in this instance.

  • Please send original-resolution images by email. Avoid screenshots or heavily compressed files.

Damage in Transit

  • Artwork is carefully packaged to prevent damage.

  • In the rare event that damage occurs during shipping:

    • Notify the artist immediately with clear photographs of the damage within 12 hrs of delivery.

    • Depending on the severity, the artwork may need to be returned.

    • If appropriate, a replacement portrait will be added to the artist’s waiting list and redrawn at no extra cost.

Artwork Materials Used Disclaimer

  • The artist uses high quality, light fast materials and archival quality paper for creating. These materials will last for many years!

  • However, the length of time your artwork remains vibrant, un-faded and ‘like new’ depends very much on where you place the piece.

  • With that in mind after delivery the artist is not responsible for the piece fading

  • To help you preserve your piece for years to come:

    • Do not place in direct or where sunlight will constantly shine on the piece

    • If you are placing in a sunny room, do frame using UV glass to help prevent fading

Print Reproduction Disclaimer

  • Great care is taken to reproduce artwork accurately in any prints.

  • However, variations may occur due to:

    • Scanner or printer settings

    • Paper type or finish

    • Individual screen calibration

  • The artist cannot guarantee a 100% colour or tone match between prints and original artwork.

Privacy & Data Protection

  • The artist will never sell, share, or distribute your personal information to third parties.

  • Information collected is used solely for the purposes of fulfilling your order and maintaining contact.

  • All data is stored securely and handled in accordance with UK data protection regulations.

VAT & Import Fees

  • The artist is not currently VAT-registered and does not charge VAT on sales within the UK.

  • International clients may be subject to customs duties, taxes, or import fees, which are the responsibility of the buyer.

  • These charges are not included in the commission or shipping price.

Additional Terms

  • Commissioning artwork from Mark Mannering Barton indicates acceptance of these terms.

  • The artist reserves the right to decline any commission request that is inappropriate or outside the scope of their work.

  • If a client fails to respond to essential communication (e.g. reference image approval or final sign-off) within 14 days, the commission may be delayed or cancelled, and payments retained.

  • These terms may be updated by the artist at any time. Clients are encouraged to review them before making a booking.

Acceptance of Terms

By placing an order or paying a deposit, you confirm that you have read, understood, and agreed to these Terms and Conditions.
