Terms and Conditions

1. Copyright & Intellectual Property

All artwork created by Mark Mannering Barton, including original works, commissioned portraits, preparatory sketches, digital mock-ups and prints, remains the intellectual property of the artist.

The artist retains full copyright and reproduction rights to all artwork produced.

The artist reserves the right to reproduce artwork for prints, promotional materials, website use, social media, exhibitions or other marketing purposes.

Purchasing a commission or print does not transfer copyright or reproduction rights. The buyer may not reproduce, resell, distribute, alter or commercially exploit the artwork without written permission.

If you wish to purchase full usage or reproduction rights, this must be agreed separately in writing.

2. Commissioned Portraits

Booking & Deposits

A non-refundable deposit is required to secure a commission booking.

Work will not begin until the deposit has been received and confirmed.

The remaining balance must be paid in full and cleared prior to shipping or collection.

All payments are accepted by UK bank transfer unless otherwise agreed.

All prices are listed in GBP (£). The artist is not currently VAT registered and therefore does not charge VAT.

Lead Times & Deadlines

Commissions are completed on a first-come, first-served basis.

Lead times vary depending on current workload and may be up to four months.

An estimated completion timeframe will be provided at the time of booking.

If a portrait is required for a specific date (e.g. birthday or event), this must be communicated at the time of enquiry. A priority or rush fee may apply where appropriate.

Delays caused by late payments, delayed approvals or incomplete information may extend the completion timeframe.

Revisions & Approval

A preview image of the completed artwork will be provided prior to delivery.

Minor adjustments may be possible at this stage.

Significant alterations or changes requested after approval may incur additional charges.

By commissioning artwork, the client acknowledges and accepts the artist’s individual style and interpretation. Exact photographic replication, precise colour matching or specific dimensional adjustments cannot be guaranteed.

Reference Photographs

Clients are responsible for providing clear, high-resolution reference images.

The artist will advise if an image is unsuitable.

Screenshots, heavily compressed files or low-quality images may affect the final result.

The artist reserves the right to decline a commission if suitable reference material is not provided.

Cancellations

Deposits are non-refundable, as they secure booking time and cover administrative work.

If a client cancels after work has commenced, payments made may be retained to cover time already invested.

Artwork Materials Disclaimer

High-quality, lightfast and archival materials are used for both original artwork and prints.

However, longevity depends on display conditions.

To preserve artwork:

  • Avoid prolonged direct sunlight

  • Consider framing with UV-protective glass

  • Avoid high humidity environments

The artist cannot be held responsible for fading or damage caused by improper display conditions after delivery.

3. Shipping & Delivery (Commissions & Prints)

All artwork is securely packaged and shipped using tracked delivery services.

If shipping directly to a gift recipient, the delivery address must be clearly provided.

Local hand delivery may be available at the discretion of the artist.

International orders may incur additional shipping charges and customs duties. Any customs fees, import taxes or local charges are the responsibility of the buyer.

Damage in Transit

In the unlikely event of damage during transit, the buyer must notify the artist within 48 hours of delivery and provide clear photographic evidence.

Where appropriate, the artwork may need to be returned before a replacement or resolution is arranged.

4. Fine Art Prints

All prints are produced using professional Giclée printing methods on archival-quality paper.

While every effort is made to reproduce artwork accurately, slight colour variations may occur due to printing processes, paper type or individual screen settings.

Prints are produced to order. Unless damaged in transit, prints are non-refundable and refunds may require the damaged print to be returned.

5. Art Tuition

Booking & Payment

Private tuition fees must be paid prior to each session unless otherwise agreed.

Block bookings must be paid in advance.

Cancellations & Rescheduling

A minimum of 3 working days notice is required to reschedule a lesson.

Sessions cancelled with less than the above notice may be charged in full.

If the artist needs to reschedule a session, reasonable notice will be given and an alternative date offered.

Tuition Disclaimer

Progress in art tuition varies according to individual practice, engagement and experience.

The artist does not guarantee specific artistic outcomes or skill levels.

6. Privacy & Data Protection

Personal information provided by clients is used solely for fulfilling orders, booking tuition and maintaining communication.

Information will never be sold or shared with third parties.

All data is handled in accordance with UK data protection regulations.

7. VAT & Import Fees

The artist is not VAT registered and does not charge VAT on UK sales.

International buyers are responsible for any customs duties, import taxes or local fees charged by their country.

8. Additional Terms

The artist reserves the right to decline any commission or booking request that falls outside the scope of their practice.

If a client fails to respond to essential communications (such as approvals or required information) within 14 days, the commission or booking may be delayed or cancelled.

These Terms & Conditions may be updated at any time. Clients are encouraged to review them prior to booking.

By placing an order, paying a deposit or booking tuition, you confirm that you have read, understood and agreed to these Terms & Conditions.
